How high is the statutory basic allowance for 2023 / 2024

The basic allowance for a P account is currently EUR 1,340.00 per calendar month (as of February 23, 2023).

In the new garnishment table for 2023/2024, the monthly garnishment-free amount was increased to EUR 1,340.00 according to §§ 899 ZPO paragraph 1 in conjunction with §§ 850c paragraph 1 in conjunction with paragraph 4 ZPO.

Since 01. July 2023 is the garnischment free amount 1.409,99 €. Since The amount that cannot be seized increases with the number of people you have to pay maintenance for.

Sometimes debtors are entitled to additional amounts of money protected by law that go beyond the basic allowance mentioned. In these cases, the allowance for the P account can be further increased with the help of a P account certificate.

§ 902 Nr. 1 bis 6 ZPO regulates the cases in which an increase in the tax-free amount can be certified.


Cases for further increase of the basic allowance of the P account:

➜ In the case of statutory maintenance obligations for up to 5 people➜ Receipt of social benefits according to SGB II, SGB XII or the AsylbLG➜ Payments intended to compensate for the additional expenses due to bodily injury or damage to health (§ 54 SGB I)➜ Cash benefits from the “Mother and Child – protection of unborn life”➜ Child benefit and other statutory cash benefits for children➜ One-off social benefits

What you need to know & consider about banks and the P account
 

Banks are only obliged to observe the basic allowance in the case of attachments. All individual increases in the garnishment exemption amount must be documented in accordance with Section 903 (1) ZPO in accordance with Sections 902 and 904 ZPO before the bank takes them into account.

 

As long as this is not available to the bank where you have the garnishment protection account (P account), only the basic exemption amount is considered non-garnishable. This means that the institute pays out to the creditors, you only have 1,340 euros left, although you would be entitled to a significantly higher non-attachable sum.

An account garnishment is the result of an enforcement action initiated by a creditor against a debtor.

If the amount of money paid into the debtor's account in a month exceeds the established allowance or the account holder does not use the entire sum, the money is initially transferred to a sub-account of the P account and is not immediately forwarded to the creditors. This sub-account is referred to as a (PSK) withdrawal account.
